Business, labor groups reach immigration deal as overhaul advances

WASHINGTON (Reuters) - Major U.S. business and labor groups have reached an agreement on a guest-worker program that removes a major hurdle to a broad immigration overhaul and clears the way for Senate legislation to be introduced soon, a source familiar with the deal said on Saturday.
The agreement was reached on Friday night between the head of the U.S. Chamber of Commerce, Tom Donohue, and the president of the AFL-CIO labor organization, Richard Trumka, with New York Democratic Senator Chuck Schumer acting as the mediator, said the source, who spoke on condition of anonymity.
A guest-worker program has been a major stumbling block to efforts by a bipartisan group of senators known as the Gang of Eight to come up with a compromise on a way to create a pathway to citizenship for the 11 million illegal immigrants in the United States.
Labor unions have worried that a flood of low-wage immigrant laborers would take away jobs from Americans. The agreement covers the pay levels for low-skilled temporary workers and the types of jobs that would be included.
Schumer briefed White House Chief of Staff Denis McDonough on Saturday on the breakthrough, the source said.
The agreement still must be approved by the Gang of Eight senators. If they do so as expected, Senate legislation on a broad new immigration law would be advanced in the Senate in the coming weeks.

Eiffel Tower evacuated after bomb threat
PARIS (AP) ? The Eiffel Tower was evacuated Saturday night after an anonymous caller phoned in a bomb threat, police said.
Nearly 1,400 people were sent away from the tourist attraction following a request from tower operators after the warning, a Paris police official said. Police then searched the monument with sniffer dogs, and set up a security perimeter.
No explosives were found and the site was to be reopened, the official said on condition of anonymity because she wasn't authorized to speak publicly.
French authorities have stepped up counterterrorism measures in recent weeks amid heightened concern about threats to France over its military campaign against al-Qaida-linked fighters in Mali which began more than two months ago.
The tower is occasionally evacuated because of such warnings ? at least once last year and twice in 2011. The 324-meter (1,063-foot) tower is one of the world's top tourist attractions, with millions of visitors a year.

I spotted them last year, and now they've got an actual product with an actual business model up and running in private beta: KredStreet, "The Social Stock Trader Rankings," which performs sentiment analysis on StockTwits data and a sampling of the Twitter firehose to determine traders' overall bullish/bearish feeling. They also compare reality against past sentiment to score and rank traders based on their accuracy, which is more interesting. It's a first iteration, but it looks pretty nifty, and I like the idea of a ranking system wherein unknowns can leave high-profile loudmouths in their dust by virtue of simply being right more often. Even if I feel slightly uneasy when I imagine such a system being applied to, say, tech bloggers. Actually being held accountable for what I've written in the past? Kenya Supreme Court upholds election result
NAIROBI, Kenya (AP) ? Kenya's Supreme Court on Saturday upheld the election of Uhuru Kenyatta as the country's next president, ending an election season that riveted the nation amid fears of a repeat of the 2007-08 postelection violence.
Outside the Supreme Court, police fired tear gas at Odinga supporters, the second time that has happened in this post-election period.
Outbreaks of violence by angry Odinga supporters were reported in some Nairobi slums and truckloads of police were called in to quell the demonstrations, according to reports on a police radio heard by an Associated Press reporter.
But jubilant Kenyatta supporters flooded the streets of downtown Nairobi, honking horns, blowing the noisy plastic horns known as a vuvuzelas and chanting.
Saturday's verdict ? following a drawn-out court case that raised tensions across the nation ? means that Kenyatta will be sworn in as president on April 9. He will become the second sitting president in Africa to face charges at the International Criminal Court. Kenyatta and Deputy President-elect William Ruto both face charges that they helped orchestrate the 2007-08 postelection violence in which more than 1,000 people died. Both deny the charges. Ruto's trial is set to begin in late May; Kenyatta's is to start in July. Kenyatta has promised to report to The Hague.
Lawyers for challenger Raila Odinga, who finished second, had argued before the Supreme Court that the election was marred by irregularities and that Kenyatta did not win enough votes to avoid a runoff election.
According to official results, Kenyatta won 50.07 percent of the vote, narrowly avoiding a runoff election against Odinga, who said his case before the Supreme Court would put Kenya's democracy on trial.
But the Supreme Court's unanimous verdict, read out by Chief Justice Willy Mutunga, said the election was "conducted in compliance with the constitution and the law" and that Kenyatta and Ruto were legally elected.
"It is the decision of the court that (Kenyatta and Ruto) were validly elected," the ruling said. The reasons behind the judges' decision were not given Saturday. The chief justice said a detailed judgment would be delivered within two weeks.
Unlike after the 2007 election, which degenerated into tribe-on-tribe violence that killed more than 1000 people, this time Odinga said he had faith in the judiciary's ability to give him a fair hearing. Odinga, who said he would respect the court's decision whether it favored him or not, was set to address reporters in Nairobi later on Saturday. As Kenyatta's supporters celebrated outside the court premises, police fired tear gas to break up a crowd of Odinga supporters.
The court's ruling ends days of anxiety since March 9, when Kenyatta was declared the winner of the March 4 vote that many described as the most complex in Kenya's history. More than 12 million Kenyans participated in the election. Some observers had expected a low registration of voters because of apathy following the 2007-08 violence, but hyped up campaigns by Kenyatta, Odinga and other presidential candidates led to the highest registration in the country ever. Kenya's electoral commission registered 14.3 million people.
Election day, though, did not go as planned. An electronic voter ID system intended to prevent fraud failed for reasons yet to be explained by the electoral commission. Vote officials instead used manual voter rolls.
After the polls closed, results were to be sent electronically to Nairobi, where officials would quickly tabulate a preliminary vote count in order to maximize transparency after rigging accusations following the 2007 vote. But that system failed, too. Election officials have indicated that computer servers overloaded but have yet to fully explain the problem.
As the early count system was still being used, election results showed more than 330,000 rejected ballots, an unusually high number. But after the count resumed with the arrival in Nairobi of manual tallies, the number of rejected ballots was greatly reduced, and the election commission said the computer was mistakenly multiplying the number of rejected ballots by a factor of eight.
Odinga's lawyers told the Supreme Court this week that the switch from electronic voter identification to manual voter roll was stage managed to allow inflation of Kenyatta's votes to take him past the 50 percent threshold. That accusation was vehemently denied by the electoral commission and Kenyatta's legal team.

Thing is, today, I'm thinking if I have a sexual relationship with a guy, after a bit, when the newness wears off, I would desperately miss the sexuality of a woman. So is my thinking. The way she moves, her curves, her softness, her sweet voice/song. I have always adored that so much. I just realized that after fantasizing about guys a lot recently, but also thinking of bisexual encounters.
That maybe I'm not going in the gay direction, but really, that I'm with a woman all the time and that maybe I miss the bi side of me. Cuz thinking about it, I think if I didn't have a woman, I'd probably crave that sexually more than anything else in my life.

EPA takes aim at auto emissions, sulfur in gas
WASHINGTON (AP) ? The Obama administration proposed new regulations Friday to clean up gasoline and automobile emissions, claiming the new standards would provide $7 in health benefits from cleaner air for each dollar spent to implement them. The costs likely would be passed on to consumers in higher gasoline and automobile prices.
The Environmental Protection Agency said the new rule would reduce sulfur in gasoline and tighten automobile emission standards beginning in 2017, resulting in an increase in gas prices of less than a penny per gallon. The agency estimated it also would add $130 to the cost of a vehicle in 2025, but predicted it would yield billions of dollars in health benefits by slashing smog- and soot-forming pollution.
EPA Acting Administrator Bob Perciasepe said the proposal is designed to "protect the environment and public health in an affordable and practical way."
The oil industry, Republicans and some Democrats wanted EPA to delay the rule, citing higher costs. An oil industry study says it could increase gasoline prices by 6 to 9 cents a gallon.
"Consumers care about the price of fuel, and our government should not be adding unnecessary regulations that raise manufacturing costs, especially when there are no proven environmental benefits," said Bob Greco, an American Petroleum Institute official. "We should not pile on new regulations when existing regulations are working."
Environmentalists hailed the proposal as potentially the most significant in President Barack Obama's second term.
The so-called Tier 3 standards would reduce sulfur in gasoline by more than 60 percent and reduce nitrogen oxides by 80 percent, by expanding across the country a standard already in place in California. For states, the regulation would make it easier to comply with health-based standards for the main ingredient in smog and soot. For automakers, the regulation allows them to sell the same autos in all 50 states.
The Obama administration already has moved to clean up motor vehicles by adopting rules that will double fuel efficiency and putting in place the first standards to reduce the pollution from cars and trucks blamed for global warming.
"We know of no other air pollution control strategy that can achieve such substantial, cost-effective and immediate emission reductions," said Bill Becker, executive director of the National Association of Clean Air Agencies. Becker said the rule would reduce pollution equal to taking 33 million cars off the road.
But the head of American Fuel and Petrochemical Manufacturers, Charles Drevna, questioned the motives behind the agency's regulation, since refining companies already have spent $10 billion to reduce sulfur by 90 percent. The additional cuts, while smaller, will cost just as much, Drevna said, and the energy needed for the additional refining actually could increase carbon pollution by 1 percent to 2 percent.
"I haven't seen an EPA rule on fuels that has come out since 1995 that hasn't said it would cost only a penny or two more," Drevna said.
A study commissioned by the American Petroleum Institute estimated that lowering the sulfur in gasoline would add 6 cents to 9 cents a gallon to refiners' manufacturing costs, an increase that likely would be passed on to consumers at the pump. The EPA estimate of less than 1 cent is also an additional manufacturing cost and likely to be passed on.
A senior administration official said Thursday that only 16 of 111 refineries would need to invest in major equipment to meet the new standards, which could be final by the end of this year. Of the remaining refineries, 29 already are meeting the standards because they are selling cleaner fuel in California or other countries, and 66 would have to make modifications.
The official spoke on condition of anonymity because the rule was still undergoing White House budget office review.

Bill Allowing Gold and Silver as Money; Bureaucratic Nightmare ...
I have encouraging news in the state of Arizona where lawmakers back gold, silver as currency.
The measure is Arizona's latest jab at the federal government, which prohibits states from minting their own money. It also reflects a growing distrust of government-backed money.
The bill, which advanced in a 4-2 vote by a House committee Monday, states that gold and silver should be legal currency not subject to tax or regulation as property. The Republican-led Senate gave the bill its blessing in February in a 17-11 partisan vote.
The bill would let people use the precious metals as money as long as businesses agree to take them. If made law, it would take effect in 2014.
Democrats oppose the measure. They say it would be a bureaucratic nightmare because businesses don't have the equipment to determine the value of gold and silver.
Bureaucratic Nightmare?Nonsense.
The bill is well written and extremely well thought out. It does not force companies to accept gold or silver (nor should it), it merely allows businesses to do so if they want. Any company that does not want to deal with gold or silver will not have to. So where's the nightmare?
States will not be minting their own money under such a proposal (nor should they) so there is no conflict on that part of Federal law.
I commend this bill, expect Arizona lawmakers to pass it, and urge the Governor to sign it. When that happens, gold will once again be legal money.
I support gold as money and believe gold is money whether or not the bill passes.

New Soyuz route cuts travel time to ISS from two days to six hours
Normally, a trip from Earth to the ISS takes about two days. Thursday, a Soyuz capsule docked with the orbiting laboratory after less than six hours of flight time, setting a record. Accelerating the trip wasn't an issue of newer technology or more powerful engines, necessarily, but of better math and planning. The Russian vehicle essentially took a shortcut that required precisely timed steering over the course of four orbits, putting three crew members (including one American astronaut) on the space station at 10:28pm ET -- just five hours and 45 minutes after takeoff from Kazakhstan. Russian engineers are already looking at ways to trim more time off the trip, by cutting two more orbits from the route. Obviously the human cargo appreciates spending less time in the cramped quarters of the Soyuz. But getting equipment and materials for experiments to the ISS quicker should also yield better and more reliable scientific results. Killer Waves: How Tsunamis Changed History
In a jumbled layer of pebbles and shells called the "Dog's Breakfast deposit" lies evidence of a massive tsunami, one of two that transformed New Zealand's Maori people in the 15th century.
After the killer wave destroyed food resources and coastal settlements, sweeping societal changes emerged, including the building of fortified hill forts (p?) and a shift toward a warrior culture.
"This is called patch protection, wanting to guard what little resources you've got left. Ultimately it led to a far more war-like society," said James Goff, a tsunami geologist at the University of New South Wales in Australia.
The Maori were victims of a one-two punch. An earthquake on the nearby Tonga-Kermadec fault triggered the first tsunami in the mid-15th century. It was soon followed by an enormous wave triggered by an exploding volcano called Kuwae, near Vanuatu. The volcano's 1453 eruption was 10 times bigger than Krakatoa and triggered the last phase of worldwide cooling called the Little Ice Age.
The tsunamis mark the divide between the Archaic and Classic periods in Maori history, Goff said. "The driver is this catastrophic event," he told OurAmazingPlanet.
Goff is one of many scientists searching for ancient tsunamis in the Pacific and elsewhere. The devastating 2004 Indonesia tsunami and earthquake, which killed 280,000 people, brought renewed focus on the hazards of these giant waves. Understanding future risk requires knowing where tsunamis struck in the past, and how often. As researchers uncover signs of prehistoric tsunamis, the scientists are beginning to link these ocean-wide events with societal shifts.
"Following 2004, there has been a lot of re-thinking and a greater appreciation for how such events would have impacted coastal settlements," said Patrick Daly, an archaeologist with the Earth Observatory of Singapore.
Vulnerable islands
The West's written history and legends clearly illustrate the consequences of tremendous tsunamis in the Mediterranean. A great wave destroyed Minoan culture on the Greek island of Crete in 1600 B.C. The same tsunami may be responsible for the legend of Atlantis, the
verdant land drowned in the ocean. More recently, in 1755, an enormous tsunami destroyed Lisbon, Portugal, Europe's third-largest city at the time. The destruction influenced philosophers and writers from Kant to Voltaire, who references the event in his novel "Candide." [10 Tsunamis That Changed History]
But islands face a much greater threat from tsunamis than coastal communities. After the Lisbon tsunami, the king of Portugal immediately set out to rebuild the city, which was only possible thanks to the presence of untouched inland areas.
"An island becomes totally cut off from the outside world," said Uri ten Brink, a marine geologist with the U.S. Geological Survey in Woods Hole, Mass. "Islands are a lot more vulnerable to such disasters. It's the same kind of thing as during bad hurricanes. It takes a lot longer to recover."
Exposed on all sides, islands are simply more likely to be hit by tsunamis. People settle in shallow bays, which are protected from storms but actually magnify the height of incoming tsunami waves. Food in these societies comes from marine resources, which are destroyed by tsunamis, and croplands that become inundated with saltwater. Boats are smashed, halting trade and communication. Goff said women, children and the elderly are most likely to die, and in Polynesian culture, elders hold the knowledge needed to build boats, make tools and grow food.
The islands of the Pacific are particularly vulnerable. About 85 percent of the world's tsunamis strike in the Pacific Ocean, thanks to its perilous tectonics. Tsunamis are waves triggered when earthquakes, landslides or volcanic eruptions shove a section of water. Ringed by subduction zones, spots where one of Earth's plates slides beneath the other, the Pacific suffers the world's most powerful earthquakes, and it holds the highest concentration of active volcanoes.
But the kind of tsunami that can change history, one that sweeps across the entire ocean, is rare.
"There are many tsunamis where there's been no cultural response or no obvious one," Goff said. "The smaller events aren't going to be the game changers."
Polynesia and tsunamis
But Goff thinks he's found a "black swan" that hit 2,800 years ago, the result of an enormous earthquake on the Tonga-Kermadec subduction zone, where two of Earth's tectonic plates collide. The tsunami scoured beaches throughout the Southwest Pacific, leaving distinctive sediments for scientists to decode. Goff's findings are detailed in several studies, most recently in the February 2012 issue of the journal The Holocene.
The tsunami coincides with the mysterious long pause, when rapid Polynesian expansion inexplicably stopped for 2,000 years. Before the pause, settlers had swiftly crossed from New Guinea to Fiji, Tonga and Samoa over the course of about 500 years.
"It's one of those archaeological conundrums," Goff said. "Why? Well, if I just had my culture obliterated, it might take me a little time to recover. It's probably not the only explanation, but it very well could have been the root cause of why they stopped," he told OurAmazingPlanet.
Two tsunamis in the 15th century had a similarly chilling effect on Polynesian society. After leaving Samoa between AD 1025 and 1120, Polynesians spread across the Pacific Ocean, discovering nearly all of the 500 habitable islands there, according to a study published Feb. 1, 2011, in the Proceedings of the National Academy of Sciences. Following the tsunamis, the culture contracted, with the rise of chiefdoms, insularity and warfare, Goff said. "There was a major breakdown at exactly that time," Goff said. "You have to live on what you have on your island, and that causes warfare and a fundamental shift in how they go about living."
Indian Ocean tsunami history
Paleotsunamis also froze trade in the Indian Ocean, according to recent studies by geologists and archaeologists.
Along the Sunda fault off the Indonesian island of Sumatra, which spawned the deadly 2004 tsunami, growth patterns in coral reefs record past earthquakes. Combined with sediment layers that point to past tsunamis and historic records of cultural shifts, the clues suggest a 14th century tsunami with an impact as great as the modern cataclysm.
After the 14th-century tsunami, Indian Ocean traders shifted to the sheltered northern and eastern coasts in the Straits of Malacca, and activity ceased in coastal settlements in the same area hit by the 2004 wave, said Daly of Singapore's Earth Observatory.
"We think that the 14th century tsunami disrupted one of the main trading routes connecting the Indian Ocean with China and Southeast Asia, a far more powerful impact on a global scale than what happened in 2004," Daly said.
After about a century, there was a gradual shift back, leading to the establishment of the flourishing Acehnese Sultanate from the 16th century, he said.
"It is interesting to think that later settlement only began after the memory of the previous event had faded," Daly told OurAmazingPlanet. "A huge, unexpected deluge of water that wiped out everything along the coast would have been really traumatic and incomprehensible to people in the past, and it is reasonable to suspect that the survivors would have been very apprehensive about moving back into such areas."
Repeating the past
Warnings would be passed down in oral or written stories and legends. The Maori offer detailed accounts of a series of great waves that hit the New Zealand coast. Along the Cascadia subduction zone, west of Washington State, tribal mythology documents a 1700 tsunami, with warnings to flee to high ground.
But because history-changing waves are rare, the warnings may be lost to time, or disregarded. In Japan, stone markers warned of the height of past tsunamis, and told residents to flee after an earthquake. Not all heeded the ancient admonitions when the 2011 Tohoku earthquake struck and sent a massive wave ashore.
By studying past tsunamis and their causes, researchers such as Goff and ten Brink of the USGS hope to reduce the destruction and loss of life from future waves. Right now, ten Brink is on Anegada Island in the Caribbean, investigating whether a tsunami there between 1450 and 1600 came from Lisbon or a local source. The project started as a hunt for evidence of a magnitude 9.0 earthquake, one similar in size to those in Japan and Sumatra. Goff is assembling a database of Pacific paleotsunamis, including the 1450 wave, which ran 100 feet (30 meters) inland along the New Zealand coast.
"The reason we're interested in looking at old tsunamis is we're worried about how often these things happen," Goff said.
The question is whether increased knowledge about the scope and frequency of tsunamis will change current and future decision-making. [Read: Tsunami Warnings: How to Prepare]
"The early evidence from the last few destructive tsunamis suggests that we don't necessarily learn lessons that well, and people in general seem to be willing to remain in highly vulnerable areas," Daly said.

Pilot ejected when small airplane dives near Chattanooga; search under way

The body of a student pilot who was ejected from a small aircraft above an area east of Chattanooga, Tenn., in a freak accident Friday evening was found on Saturday, authorities said.
The man?s body was located after 8 a.m. local time, Bob Gault, a spokesman for the Bradley County Sheriff?s department, told NBC News.
The accident occurred when the owner of the Zodiac 601XL plane was taking lessons from an instructor, NBC station WRCB of Chattanooga reported, citing police. A malfunction caused the plane to nose dive and the canopy flew open ? and neither man was wearing a seat belt, WRCB reported.
The accident occurred at about 2,500 feet,?the Chattanooga Times Free Press reported.?
The instructor was able to land the aircraft back at Collegedale Municipal Airport, operations manager Chris Hancock confirmed to NBC News. He directed further questions to a Collegedale police spokesman who could not immediately be reached.
?The people inside the plane were not wearing seat belts,? said Troy Spence, director of the county?s emergency management agency, according to WRCB. ?So when they lost control of the plane, in an attempt to regain control of the plane, the passenger was ejected.?
Authorities conducted a ground search in Bradley County, WRCB said. The Times Free Press said the owner-pilot had a cell phone with him and rescuers pinged it in an attempt to find him.
Neither of the men was identified publicly by authorities.
WRCB said the plane had been owned by a man killed in a December crash and then was sold to the current owner, described as an experienced pilot who wanted more training in the Zodiac.
The Zodiac 601XL is a single-engine kit aircraft offered for home builders. Its two seats are side by side under a large domed canopy.

Earlier this month, an African lion broke out of its pen and killed a 24-year-old intern at the Cat Haven sanctuary in California who was cleaning the main enclosure. According to CNN, the?5-year-old, 350-pound?killer was one of the victim's favorites.
Captive lions tend to act on their wild instincts whenever potential prey catches their eyes. A pair of videos titled "lion tries to eat baby" have attracted in total more than 7.6 millions views on YouTube since they were uploaded last April. The clips show an Oregon Zoo lioness snarling and baring her fangs in vain at a happily oblivious toddler protected by reinforced glass.
"Most of the time they seem relaxed and cuddly?so it's easy to forget that they react to meat with the reflexive instincts of a shark." Professor Craig Packer, a leading big cat expert at the University of Minnesota, noted in a recent interview with National Geographic News.?"Ten years ago Roy Horne (of Siegfried ?and Roy) was attacked by a tiger that they had handled for years?these attacks happen when people forget about the shark inside."

Iran, North Korea, Syria block U.N. arms trade treaty

UNITED NATIONS (Reuters) - Iran, Syria and North Korea on Friday prevented the adoption of the first international treaty to regulate the $70 billion global conventional arms trade, complaining that it was flawed and failed to ban weapons sales to rebel groups.
To get around the blockade, British U.N. Ambassador Mark Lyall Grant sent the draft treaty to Secretary-General Ban Ki-moon and asked him on behalf of Mexico, Australia and a number of others to put it to a swift vote in the General Assembly.
U.N. diplomats said the 193-nation General Assembly could put the draft treaty to a vote as early as Tuesday.
"A good, strong treaty has been blocked," said Britain's chief delegate, Joanne Adamson. "Most people in the world want regulation and those are the voices that need to be heard."
"This is success deferred," she added.
The head of the U.S. delegation, Assistant Secretary of State Thomas Countryman, told a group of reporters, "We look forward to this treaty being adopted very soon by the United Nations General Assembly." He declined to predict the result of a vote but said it would be a "substantial majority" in favor.
U.N. member states began meeting last week in a final push to end years of discussions and hammer out a binding international treaty to end the lack of regulation over cross-border conventional arms sales.
Arms control activists and human rights groups say a treaty is needed to halt the uncontrolled flow of arms and ammunition that they say fuels wars, atrocities and rights abuses.
Delegates to the treaty-drafting conference said on Wednesday they were close to a deal to approve the treaty, but cautioned that Iran and other countries might attempt to block it. Iran, Syria and North Korea did just that, blocking the required consensus for it to pass.
Iranian President Mahmoud Ahmadinejad had told Iran's Press TV that Tehran supported the arms trade treaty. But Iranian U.N. Ambassador Mohammad Khazaee told the conference that he could not accept the treaty in its current form.
"The achievement of such a treaty has been rendered out of reach due to many legal flaws and loopholes," he said. "It is a matter of deep regret that genuine efforts of many countries for a robust, balanced and non-discriminatory treaty were ignored."
One of those flaws was its failure to ban sales of weapons to groups that commit "acts of aggression," ostensibly referring to rebel groups, he said. The current draft does not ban transfers to armed groups but says all arms transfers should be subjected to rigorous risk and human rights assessments first.
'HELD HOSTAGE'
Syrian Ambassador Bashar Ja'afari echoed the Iranian concerns, saying he also objected to the fact that it does not prohibit weapons transfers to rebel groups.
"Unfortunately our national concerns were not taken into consideration," he said. "It can't be accepted by my country."
North Korea's delegate voiced similar complaints, suggesting it was a discriminatory treaty: "This (treaty) is not balanced."
Iran, which is under a U.N. arms embargo over its nuclear program, is eager to ensure its arms imports and exports are not curtailed, diplomats said. Syria is in a two-year-old civil war and hopes Russian and Iranian arms keep flowing in, they added.
North Korea is also under a U.N. arms embargo due to its nuclear weapons and missile programs.
Russia and China made clear they would not have blocked it but voiced serious reservations about the text and its failure to get consensus. A Russian delegate told the conference that Moscow would have to think hard about signing it if it were approved. India, Pakistan and others complained that the treaty favors exporters and creates disadvantages for arms importers.
If adopted by the General Assembly, the pact will need to be signed and ratified by at least 50 states to enter into force.
Several diplomats and human rights groups that have lobbied hard in favor of the treaty complained that the requirement of consensus for the pact to pass was something that the United States insisted on years ago. That rule gave every U.N. member state the ability to veto the draft treaty.
"The world has been held hostage by three states," said Anna Macdonald, an arms control expert at humanitarian agency Oxfam. "We have known all along that the consensus process was deeply flawed and today we see it is actually dysfunctional."
"Countries such as Iran, Syria and DPRK (North Korea) should not be allowed to dictate to the rest of the world how the sale of weapons should be regulated," she added.
The point of an arms trade treaty is to set standards for all cross-border transfers of conventional weapons. It would also create binding requirements for states to review all cross-border arms contracts to ensure arms will not be used in human rights abuses, terrorism or violations of humanitarian law.
The main reason the arms trade talks took place at all is that the United States - the world's biggest arms exporter - reversed U.S. policy on the issue after President Barack Obama was first elected and decided in 2009 to support an arms treaty.
Washington demanded that the conference be run on the basis of consensus because it wanted to be able to block any treaty that undermined the U.S. constitutional right to bear arms, a sensitive political issue in the United States. Countryman said the draft treaty did not undermine U.S. rights.
The National Rifle Association, a powerful U.S. pro-gun lobbying group, opposes the treaty and has vowed to fight to prevent its ratification if it reaches Washington. The NRA says the treaty would undermine domestic gun-ownership rights.
The American Bar Association, an attorneys' lobby group, has said that the treaty would not impact the right to bear arms.

Chesapeake names Dixon interim CEO as McClendon set to leave

McClendon is expected to step down on Monday.
In a statement Chesapeake, the second-largest producer of natural gas, said its board has established an Office of Chairman to steer the company after McClendon leaves. The three-man team will also include Chesapeake's non-executive Chairman Archie Dunham and Chief Financial Officer Domenic Dell'osso.
McClendon's departure was announced in late January, following a governance crisis and a liquidity crunch caused by heavy spending on oil and gas properties, and a collapse in the price of natural gas.
Chesapeake's board is considering both internal and external candidates for the job they had initially said would be filled by April 1.
Friday's announcement, however, indicates that the search for McClendon's successor is going to take longer than previously anticipated.
"Chesapeake continues to perform well and is successfully executing our strategy to increase liquids production, drive capital efficiencies across the business, and enhance financial flexibility to prudently fund growth," Dunham said in a statement.
Analysts have said several factors may have complicated the search: the oil producer faces financial and regulatory headwinds, it has a knotty financial structure that needs to be simplified, and there is a crowded field of public energy companies on the hunt for a CEO.
Chesapeake, which also drills new oil wells, has to fill a projected $4 billion gap between cash flow and spending this year and sell up to $7 billion in assets to help make up that shortfall in an environment where deal valuations have softened.
Chesapeake, based in Oklahoma City, Oklahoma, could not be immediately reached for additional comment.
McClendon, who co-founded Chesapeake in 1989, was one of the first oil and gas executives to recognize the vast potential of the country's shale basins. But he stepped down as chief executive after a tumultuous year in which a series of Reuters investigations triggered civil and criminal probes of the second-largest U.S. natural gas producer.
A company probe of the same matter found no intentional wrongdoing on McClendon's part.

Sprint's Galaxy S 4 recently took one step towards being ready for mass consumption, however the carrier hasn't forgotten the device's forefathers. We've received a memo from an anonymous tipster advising that the Epic 4G Touch is set to make the jump to Jelly Bean (Android 4.1, to be exact) starting sometime today. The new software bump will come directly from Samsung and will require a visit to an external website that has yet to go live. The memo also notes that in order to perform the update, you'll need access to a rig with Windows 7, Vista or XP -- in other words, OS X and Windows 8 users will have to visit a Sprint store to get their fix. For those fortunate enough to gain access in the coming hours, let us know how it's treating you in comments below.
Update: Waiting for official confirmation? Then just check Sprint's official log of updates for the Epic 4G Touch on its website, which now lists the GB27 version. What matters (and what doesn't) when buying a gaming desktop ...
Want to game on a PC? Buy a desktop. While notebooks have come a long way over the last decade, they are, to this day, an inherently compromised solution. Fast processors and video cards consume gobs of power and produce tons of heat, so mobile systems have to cut back on performance while packing on the pounds.
That leaves desktops to bear the weight of PC gaming. Even a modest system can put current consoles to shame and run today?s most demanding games at 1080p. Want more? You can have it. The most powerful gaming rigs are several times faster than the least powerful, and every gradation of performance between those extremes is available.
Yet, there?s more to the equation than raw horsepower. Upgradability, storage, and add-on cards also deserve thought. This guide will help you cut through the confusion and buy an amazing gaming desktop computer at a surprisingly low price.?
One size doesn?t fit all
Most gamers start with the hardware inside a computer. We?ll cover that soon enough, but, before we get there, let?s talk about the exterior.
Gaming computers now come in many shapes and sizes. There are small systems like the?Falcon Northwest Tiki, mid-size towers like the?Acer Predator,?and monoliths like the?Origin Genesis.
Small systems are, well, small. They are unobtrusive and fit where larger systems simply can?t. They?re ideal for gamers who lack a large desks or want to use the desktop in a home theater. Going small can limit future upgrade options, however, and some pint-sized PCs?make a lot of noise.
Mid towers are a good compromise and are ideal for most people. They?re small enough to fit under, on, or in a typical desk, yet large enough to offer upgradability and acceptable cooling. Flair, or lack thereof, is the only flaw. Most mid towers look like any other ho-hum desktop.
Finally, we come to the monoliths known as full towers. These are often so large that they won?t fit on top of a desk without hanging off the front or rear, and a few full towers are so tall they won?t even fit under a desk. A full tower system can also carry a slightly higher premium over a mid tower. However, full towers are easy to upgrade and can handle hardware that won?t fit in smaller PCs.
Some custom manufacturers, like Origin and CyberPower, offer a selection of cases during customization. We recommend the full tower if you can find room for it, but make sure you understand the size before buying. Otherwise, a mid tower is best. Smaller systems can be great, but are also a niche solution. You should only buy one if space is at a premium or you?re dead set on a small system for aesthetic reasons.
Start with the heart: The processor
When you buy a gaming desktop, be it a customized model from a boutique or a pre-made model from Dell or HP, the processor will be the first specification you see ? and for good reason. The processor determines how a system will perform in most software.
Your first choice will be between dual- or quad-core processors. We recommend a quad unless your budget is extremely low ($1,500 or less). A dual-core processor is often fine, but some modern games make use of additional cores and can be crippled by a dual-core CPU.
Gamers with a lot of money may be lured in by Intel?s six-core processors. These are priced at a premium and not worthwhile for gaming. We only recommend them to buyers who have absolutely no concern about a rig?s final price. The same can be said of Intel?s Extreme Edition processors.
Also, we suggest you avoid AMD. Though potentially competitive at a few price points, and boasting up to eight cores, all of the company?s processors fail to offer solid single-thread performance. That?s a problem for games because most place their heaviest load on just one or two cores.
A great GPU makes a great gaming PC
The video cards sit side-by-side with the processor in importance. This one component is entirely responsible for drawing the beautiful graphics you see onscreen. Faster video cards allow better, smoother graphics and a more immersive experience.
As a gamer, you?ll want to stay away from low-end cards. In Nvidia?s stable, this means you want to stay away from products that have a 20, 30, or 40 in their model number (like the GT 630). In AMD?s product line, you want to stay away from cards that have a 4, 5, or 6 as the second digit in the model number (like the Radeon 6670).
The price-performance sweet spot usually sits with mid-range cards like the Nvidia GTX 660 and AMD Radeon HD 7850. These can handle almost any game in 1080p with full detail. If you want to make sure that games run well, or you want to play at an even higher resolution, like 2560 x 1600, you should move up to an even more powerful card.
While shopping, you may sometimes find yourself with a choice between two cards that are similar but offer different memory. More memory does not have a significant impact on overall performance by itself, but more memory does allow a video card to handle more data before choking. We recommend at least 1GB of memory if you have a display below 1080p resolution, and at least 2GB of memory if your display is 1080p or above.
We don?t recommend multiple video cards. Though potentially quick, multi-card configurations often run into driver or game support issues that prevent them from unlocking their full potential. They?re also louder and hotter than a single card.
Don?t waste money on too much RAM
Our recent review of the?Acer Predator?provided the perfect example of how marketing is sometimes placed before performance. That system, which is relatively affordable, came to us with 32GB of RAM. Thirty-two! As in 30, and then two more.
That?s insane, yet not uncommon. Why? RAM is currently inexpensive, so adding more makes a system seem powerful to uneducated consumers at minimal cost. But, don?t fall for it. The majority of games sold today will run well on a computer with only 4GB of RAM (as we proved in our?Steam Box build). For a serious gaming rig, however, 8GB is our recommendation. Anything on top of that is effectively useless.
Additional memory doesn?t make a game run more quickly; it merely sits unused. Any money that might be spent on RAM beyond 8GB should instead be put towards a component that matters.
Solid-state drives are expensive, but useful
Most computers sold today come with at least a 500GB mechanical hard drive and, in most cases, a 750GB or 1TB model. More space is better, but unused space isn?t needed, so our recommendation is simple: buy as much space as you need.
Whether or not you should buy a computer with a solid-state drive is a more difficult question. SSDs are many times more expensive than mechanical drives when measured by gigabyte-per-dollar. They also have no impact on in-game performance. Still, we recommend that you buy an SSD if you can afford one that offers over 200GB of storage. Why?: load times.
A solid-state drive is many times quicker than a mechanical drive. For games, this means a level that could take 30 seconds to load on a normal drive instead loads in 5 to 10 seconds. Games with short load times may sometimes load almost instantly.
If you do choose a solid-state drive, make sure it?s also the drive that contains the operating system. You?ll gain the benefit of quick boot times and fast operation in day-to-day use. This is also why we don?t recommend an SSD with less than 200GB of space. With Windows installed, a small drive can only contain a handful of games.?
Don?t lose money on the kitchen sink
?
After you?ve nailed down the processor, video card, RAM and hard drive you?ll start to browse through a wide selection of extras including sound cards, Ethernet adapters, additional USB ports, and more.
These extras aren?t required. Today?s motherboards ship with a built-in sound card, Ethernet adapter, and gobs of connectivity. Some even come with standard Wi-Fi. These have made peripheral cards far less of a necessity.
That doesn?t mean they?re useless, but skip it if you don?t already?know?that you need a certain add-on card for a specific reason.

As you browse computers and choose custom hardware, you should always return to one question: ?Does this make games look and play better??
